Our Terms and Conditions

All cakes ordered from The Cake Tin Kitchen are subject to the following Terms and Conditions. Please read them carefully before transferring any money to The Cake Tin Kitchen. By transferring money, you are confirming that you have read and understood the following and are agreeing to enter a contract with The Cake Tin Kitchen.

Designs

• All cake designs can be customised but the result is dependent on the information given to The Cake Tin Kitchen by the customer. The interpretation of customers’ bespoke requirements and amendments to the designs are approved by the customer during the consultation and order process. Written descriptions will be used to explain what the customer will receive.

• The Cake Tin Kitchen will do its best to match any colour requests but we cannot guarantee an exact match as colours present differently in different materials. We aim for a perfect match but this is not always possible.

• All of our cakes at The Cake Tin Kitchen come with matching ribbon around the base board as standard unless another colour is requested.

Allergies & Special Dietary Requirements

• Unless you have informed us of any dietary requirements, all cakes made by The Cake Tin Kitchen contain butter, gluten (wheat) and eggs and are made in an environment that handles nuts, soya and alcohol.

• Nut-free, dairy-free and gluten-free cakes can be made on request and whilst every effort is made to keep these products separate, we cannot guarantee that these cakes will not contain trace amounts of these ingredients due to the nature of production.

• The Cake Tin Kitchen accepts no liability for customers suffering allergic reactions from eating our cakes.

• It is the customer’s responsibility to make The Cake Tin Kitchen aware of any special dietary requirements that need to be accommodated in the making of their cake.

Consultation and Tasting

• We do offer wedding Sample Boxes . Customers may opt to try 4 of our Flavours to be chosen by the customer at the time of booking. (The Cake Tin kitchen does not offer a postal service for our sample boxes)

Our sample boxes are charged at £30.00. Additional flavours are available for a small fee

• Customers to The Cake Tin Kitchen, who are considering ordering a wedding cake are invited to a consultation and tasting session. Customers may opt to try 4 of our flavours to be chosen by the customer at the time of booking. Additional flavours are available for a small fee.

• The consultation and tasting fee of £15..00 per person is redeemable against the purchase of your cake up to 2 persons. However, please note that we require 72 hours’ notice to cancel or reschedule a consultation. Failure to give this notice may result in your fee being non-refundable and non-redeemable.

• Wherever possible, consultations will take place in our home kitchen.

Prices and Portions

• The price for your order is clearly stated on your order form. By agreeing to these terms and conditions your accept responsibility for paying the full balance shown on your order form.

• All prices shown are based on portions per cake being 1”x1” finger portions for wedding and fruit cakes and 1”x2” dessert portions for celebration cakes as standard unless other portion sizes are requested by the customer. Please check these portion sizes with the venue. The Cake Tin Kitchen accepts no responsibility for portion amounts or sizes varying due to it being cut differently by venue catering staff or a family member.

Payment and deposits

• Customers will receive written quotes with a clear breakdown. • A non-refundable deposit of between £10.00-£50.00 For Celebration Cakes or £50.00 For Wedding Cakes is required to secure your order. • Deposits are non-refundable. Please refer to the section regarding cancellations for more details. • The final payment of the balance is due, at the latest, 7 days before delivery for wedding cakes and 24 hours before collection/delivery on all other cakes. Payment can be made earlier if you wish, but we require the balance closed prior to collection/delivery. • Failure to complete payment prior to delivery may result in your cake order being cancelled. • All payment of deposits and balances are requested to be paid via BACS. To discuss payments or if you’d prefer a different method of payment please contact The Cake Tin Kitchen.

Non-payment

• In the event of non-payment, a payment being declined or a no-show on collection, the order will not be completed or released until the full balance has been cleared. Until this time, the cake will remain property of The Cake Tin Kitchen. Completion of the order will be subject to funds clearing. The Cake Tin Kitchen accepts no responsibility for the cake being incomplete as a result of non-payment and the customer will be responsible for any additional charges incurred as a result.

No-show on collection

• On a no-show the customer is still liable for the full out-standing payment. As The Cake Tin Kitchen has fulfilled their part of the agreed contract and completed the ordered cake

Alterations

• Your cake is as important to us as it is to you. Please take the time to check your copy of the order form carefully and let us know as soon as possible of any changes. It is the customers’ responsibility to advise The Cake Tin Kitchen of alterations to the original order.

• Any alterations you wish to make to your confirmed, ordered cake design must be requested in writing to thecaketinkitchen@gmail.com. We will always try our best to accommodate alterations but we cannot guarantee that we will be able to make alterations at short notice.

• Alterations may affect the cost of your cake and your balance will be adjusted accordingly. We will be able to send you written confirmation of the changes.

Cancellation or Rescheduling

• We cannot refund the cost of any cakes cancelled with less than 28 days’ notice.

• Deposits are non-refundable.

• Refunds are made at the discretion of The Cake Tin Kitchen. Under no circumstances will the full amount be refunded. Any charges incurred and materials already purchased for your order are non-refundable and time spent on any decorative pieces for your order will be charged accordingly.

• Where possible we will try to accommodate rescheduling if given enough notice. Please be aware if we cannot reschedule your booking this will count as a cancellation and the cancellation procedure will be followed.

Fresh Flowers

• If a customer requests fresh flowers on their wedding cake it is the customer’s responsibility to liaise with their florist to determine the type of flowers to be used. It would be helpful to communicate this decision with the cake designer.

• The cost of fresh flowers is not included in the cake price. The cost of fresh flowers needs to be settled with your florist. Please note some flowers are toxic. It is the customer’s responsibility to ensure that any fresh flowers displayed on or next to the cake do not contain pesticides and are food-safe. The Cake Tin Kitchen can take no responsibility for the flowers being food-safe.

• Once The Cake Tin Kitchen has set up the cake at the venue . The Cake Tin Kitchen do not take any responsibility for any damage to the cake from the fresh flowers, or the placement on the cake of the fresh flowers.

Non-edible Materials

• Any non-edible decoration such as toppers, wired or fresh flowers, brooches, silk ribbon etc. that are used to decorate your cake with your permission must be removed from the cake prior to serving. The named recipient of the cake will be told or handed a form on delivery, detailing any non-edible materials including any hidden supports inside the cake to be removed when serving. This information will need to be given to whoever will be cutting and serving the cake.

Collection

• All customers are welcome to collect their cake from our business premises, after which time The Cake Tin Kitchen takes no responsibility for any damage done to the cake.

• The Cake Tin Kitchen can provide assembly instructions for collection cakes, if necessary, and accepts no liability for self-assembly cakes that are not assembled properly or are damaged during assembly. Please note some larger or more decorative cakes may not be suitable for collection.

• Cakes must be collected at a given time up to 8pm, after which time the business premises will be deemed closed.

Delivery

• We suggest you allow us to safely deliver and set up your wedding cake. We do charge a small fee for delivery.

• All delivery dates and times are subject to availability. If you have a specific delivery date and require delivery before a given time, please specify this when placing your order. The Cake Tin Kitchen will try to accommodate your requirements but delivery may not be available at short notice.

• It is the customer’s responsibility to ensure they have given The Cake Tin Kitchen correct delivery information, and that someone is available to receive their cake. We require a signed delivery note by the recipient to say that the cake has arrived and that it arrived in perfect condition, with a photograph as proof. Damages after this point are not The Cake Tin Kitchen's responsibility.

• Our delivery service is subject to reasonable access conditions. If in the unlikely event we are unable to deliver your cake due to adverse weather conditions such as snow or floods, these conditions may make your venue inaccessible and delivery will not be possible. We strongly recommend that you purchase wedding insurance to cover yourselves for this eventuality.

• We will do everything possible to ensure your cake arrives on time, but cannot accept liability for any late deliveries. If delivery is attempted and we are unable to leave the cake (for example because nobody is available to take receipt) then the responsibility is with the customer to arrange redelivery or collection and we cannot accept liability for late delivery.

Setting Up

• If you have opted for setting up this will be shown on your order form and charged accordingly. Setup fee is charged separately from delivery charge at a standard rate of £30.00+ which allows 2 hours for getting the cake into the venue, stacking, applying pieces and photographing the cake.

• Please arrange a time with your venue that will be suitable to delivery and setup your cake. If we are not able to setup within the 2 hours due to the venue not being ready, it will become the responsibility of the venue to set up the cake and The Cake Tin Kitchen accepts no responsibility for damage done to the cake due to incorrect handling by the venue staff.

• The Cake Tin Kitchen will deliver and set up your cake as agreed and will want to ensure it is displayed at its best. It is your responsibility to ensure you have provided The Cake Tin Kitchen with the correct set-up details and arrangements made with the venue for the location and display of your cake. Please ensure that the display location is level, stable and strong enough to hold the cake. The Cake Tin Kitchen cannot take any responsibility if damage is done to the cake due to an unstable table or a table placed on an unstable surface. A photograph of the cake will be taken prior to departure to verify that the cake has been set up and left in good condition.

• Please note that cakes can melt in warm conditions such as inside a marquee on a hot summer’s day, or when set up in direct sunlight. Please take care when displaying your cake at your venue to avoid direct sunlight, spotlights or candles creating damage to the cake decorations. Hand-painted cakes are especially vulnerable to heat and light damage. All of our cakes are designed to withstand normal and reasonable display conditions. The Cake Tin Kitchen accepts no liability for cakes that are damaged during display.

• Once the cake has been collected or delivered, set up and signed for and photograph, The Cake Tin Kitchen is unable to accept liability for any interference with or damage to the cake thereafter.

Damages

• All of our cakes are fragile and require care and attention when handling, storing and displaying to prevent damage occurring.

•When transporting your own cake after collection. We advise to transport in a clean/clear space of the car boot or the foot well. Preferably on a non-slip mat. The Cake Tin Kitchen accepts no liability to cakes damaged during your own transportation.

•The Cake Tin Kitchen accepts no liability for cakes that are damaged after they have been delivered to the agreed location.

Cake Storage and Shelf Life •All cakes should be stored in a cool dark place on a flat sturdy surface. •Never put cakes in the fridge unless stated otherwise. •All cakes will keep up to one week after delivery. •Fruit cake will last well for months if stored in a tin.
